This case involved a shipment of canned grapefruit juice which contained 
added sugar. Sample cans taken from the lot were found to contain less than 
one-half pint, the labeled volume.
On June 12, 1933, the United States attorney for the District of Utah, acting 
upon a report by the Secretary of Agriculture, filed in the district court a libel 
praying seizure and condemnation of 13 cases and 11 cans of grapefruit juice 
at Ogden, Utah, alleging that the article had been shipped in interstate com- 
merce on or about May 4, 1933, the shipment having been made ex steamship
