17817. Misbranding of cottonseed meal and cake. IT. S. -v. Graco Milling Co. Plea of guilty. Fine, $450 and costs. (F. & D. No. 25021. I. S. Nos. 030752, 030754, 030762, 033606, 033607, 033610, 033611, 037804.) Samples of cottonseed meal and cake from the herein-described interstate shipments having been found to contain less protein than declared on the labels, the Secretary of Agriculture reported the matter to the United States attorney for the Eastern District of Illinois. On August 29, 1930, the United States attorney filed in the District Court of the United States for the district aforesaid an information against the Graco Milling Co., a corporation, Cairo, Ill., alleging shipment by said company, in violation of the food and drugs act. between the dates of February 4, 1930, and February 11, 1930, from the State of Illinois, in various lots, into the States of Wisconsin, Iowa, Montana, Missouri, and Nebraska, of quantities of cottonseed meal and cottonseed cake which were misbranded. The article was labeled in part: (Tag) " Guaranteed Analysis Protein, not less than 43%." It was alleged in the information that the article was misbranded in that the statement, to wit, " Guaranteed Analysis Protein, riot less than 43%," borne on the tags attached to the sacks containing the article, was false and mis- leading in that the said statement represented that the article contained not less than 43 per cent of protein, and for the further reason that it was labeled as aforesaid so as to deceive and mislead the purchaser into the belief that it contained not less than 43 per cent of protein; whereas it contained less than 43 per cent of protein, the nine separate lots containing 41.01, 40.94, 40.56, 41.63, 40.65, 41.44, 39.74, 41.32, and 41.50 per cent, respectively, of protein. On October 22, 1930, a plea of guilty to the information was entered on behalf of the defendant company, and the court imposed a fine of $450 and costs. ABTHtnB M. HYDE, Secretary of Agriculture.
