17192. Misbranding of butter. U. S. v. 12 Cases of Butter. Default decree of condemnation, forfeiture, and destruction. (F. & D. No. 24679. I. S. No. 028908. S. No. 2889.) On February 20, 1930, the United States attorney for the District of New Jersey, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel praying seizure and condemnation of 12 cases of butter at Newark, N. J., alleging that the article had been shipped by Swift & Co., from Atlantic, Iowa, on or about February 8, 1930, and transported from the State of Iowa into the State of New Jersey, and charging misbranding in violation of the food and drugs act as amended. The article was labeled in part: "Brookfield Pasteurized Creamery Butter Quarters 1 Lb. Net Weight * * * Swift & Company * * * Chicago." It was alleged in the libel that the article was misbranded in that the state- ment on the label, " 1 Lb. Net Weight," was false and misleading and deceived and misled the purchaser; and in that it was food in package form and the quantity of the contents was not plainly and conspicuously marked on the out- side of the package, since the statement "1 Lb. Net Weight" was incorrect. On April 9, 1930, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
