On July 6, 1928, the United States attorney for the District of Maryland, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against Charles Neubert, trading as Charles Neubert & Co., Baltimore, Md., alleging shipment by said defendant, in violation of the food and drugs act, on or about November 21, 1927, from the State of Maryland, in part into the State of Illinois, and in part into the State of Pennsylvania, of quantities of oysters which were adulter- ated. The article was labeled in part: " Neubert's Oysters * * * Chas. Neubert & Co., Baltimore, Md." It was alleged in the information that the article was adulterated in that a substance, to wit, water, had been mixed and packed therewith so as to reduce and lower and injuriously affect its quality and strength and had been substi- tuted in part for oysters, which the article purported to be. On September 17, 1928, the defendant entered a plea of guilty to the infor- mation, and the court imposed a fine of $100 and costs. ARTHUB, M. HYDE, Secretary of Agriculture.
