15557. Misbranding of Crazy mineral water. V. S. v. 15 Cases of Crazy Mineral Water. Consent decree of condemnation and forfeiture. Product released under bond. (F. & D No. 22216. I S. No 9521-x S No. 278 ) On November 28, 1927, the United States attorney for the Western District ' of Tennessee, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for Said district a libel praying seizure and l\ condemnation of 15 cases of Crazy mineral water, at Memphis, Tenn., alleging \ that the article had been shipped by the Crazy Well Water Co., from Mineral v Wells, Tex., on or about August 23, 1927, and transported from the State of Texas into the State of Tennessee, and charging misbranding in violation of the food and drugs act as amended. It was alleged in the libel that the article was misbranded, in that the ; statements, " Rheumatism, Constipation, Functional Stomach Diseases, Liver Diseases, (Not Organic) Cystitis, Etc. * * * Diabetes, Bright's Disease, Etc.," regarding the effect of the said article, were false and fraudulent, since it contained no ingredient or combination of ingredients capable ot producing the effects claimed. On April 4, 1928, the Crazy Water Co., Mineral Wells, Texas, claimant, having admitted the allegations of the libel and having consented to the entry of a decree, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product be released to the said claimant upon i' payment of the costs of the proceedings and the execution of a bond in the t sum of $250, conditioned in part that it not be sold or otherwise disposed of ;,. contrary to law, and be relabeled under the supervision of this department. r W.
