On March 17, 1926, the United States attorney for the District of; Mary- land, acting upon a report by the Secretary of Agriculture, filed in the Dis- trict Court of the United States for said district libels praying seizure and condemnation of 263 bottles of. Bear's emulsion, remaining in the original un- broken packages at Baltimore, Md.; alleging that the article had been shipped by John D. Bear, in part from Stephenson, Va., and in part from Stephens City, Va., in various consignments, on or about September 8,"1924, January 14, 1925, September 19, 1925, December 10, 1925, and February 9, 1926, respectively, and transported from the State of Virginia into the State of Maryland, and charging misbranding in violation of the food and drugs act as amended. :? . .i' * .
