On July 2, 1925, the United States attorney for the Western District of Tennessee, acting upon a report by the Secretary of Agriculture, filed in the- District Court of the United States for said district a libel praying the seizure- tnd condemnation of 71 cases of butter, at Memphis, Tenn., alleging that the- irticle had been shipped by the Pine Bluff Creamery Co., from Pine Bluff, ^rk.. June 11, 1925, and transported from the State of Arkansas into the State- >f Tennessee, and charging misbranding in violation of the food and drugs ct as amended. The article was labeled in part: (Carton) "Jersey Creamery Sutter One Pound Net * * * Pine Bluff Creamery Butter * * * Pine Huff, Ark." Misbranding of the article was alleged in the libel for the reason that the tatement " One Pound," borne on the labels, was false and misleading and eceived and misled the purchaser, and for the further reason that the article ?as food in package form and the quantity of the contents was not plainly nd conspicuously marked on the outside of the package. On JT?ly 21. 1925. the Pine Bluff Creamer^ Co.. Pine Bluff, Ark., having ppeareil as claimant for the property, judgment of condemnation and for- iitnre was entered, and it was ordered by the court that the product be leased to the said claimant upon payment of the costs of the proceedings nd the execution of a bond in the sum of $250, in conformity with section 10 F the act, said bond providing that the product be reconditioned or relabeled ader the supervision of this department.
