On January 28, 1925, the Un1ted States attorney for the D1str1ct of Mary- land, act1ng upon a report by the Secretary of Agr1culture, f1led 1n the- D1str1ct Court of the Un1ted States for sa1d d1str1ct a l1bel pray1ng the se1zure and condemnat1on of 65 sacks of peanut meal, rema1n1ng 1n the or1g1nal unbroken packages at Bel A1r, Md., alleg1ng that the art1cle had been sh1pped by the- Suffolk O1l M1ll, from Suffolk, Va., about October 2, 1924, and transported from the State of V1rg1n1a 1nto the State of Maryland, and charg1ng m1sbrand1ng 1n v1olat1on of the food and drugs act. The art1cle was labeled 1n part: " 100' Pounds Peanut Meal Manufactured By Suffolk O1l M1ll Suffolk, Va. Guaran- teed Analys1s Prote1n 41 per cent * * * Made From Shelled Peanuts." M1sbrand1ng of the art1cle was alleged 1n the l1bel for the reason that the- statement " Guaranteed Analys1s Prote1n 41 per cent" was false and m1slead- 1ng and dece1ved and m1sled the purchaser. On February 9, 1925. the Suffolk O1l M1ll, Suffolk, Va., hav1ng appeared as cla1mant for the property, judgment of condemnat1on was entered^, and 1t was- ordered by the court that the product be released to the sa1d cla1mant upon payment of the costs of the proceed1ngs and the execut1on of a bond 1n the sum of $200, 1n conform1ty w1th sect1on 10 of the act, cond1t1oned 1m part that 1t not be sold or d1sposed of unt1l correctly labeled and 1nspected by a repre- sentat1ve of th1s department.
