On or about August 15, 1922, the United States attorney for the Southern District of West Virginia, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district a libel pray- ing the seizure and condemnation of 16 cases of canned string beans, at Blue- field, W. Va., alleging that the article had been shipped by the Rileyville Can- ning Co., Rileyville, Va., August 26, 1921, and transported from the State of Virginia into the State of West Virginia, and charging adulteration in viola- tion of the food and drugs act. The article was labeled in part: " Shenandoah River Green Beans * * * Packed by Rileyville Canning Co. Rileyville, Va." Adulteration of the article was alleged in the libel for the reason that it consisted wholly or in part of a filthy, decomposed, and putrid vegetable substance. On April 13, 1924, no claimant having appeared for the property, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product be destroyed by the United States marshal.
