On June 1,1921, the United States attorney for the District of Kansas, acting? upon a report by the Secretary of Agriculture, filed in the District Court of the? United States for said district an information against Pius Leiker, Jr., a mem?? ber of a partnership trading as P. Leiker & Sons, at Park, Kans., alleging ship?? ment by said defendant, in violation of the Food and Drugs Act, on or about? July 31, 1920, from the State of Kansas into the State of Colorado, of a quantity? of shell eggs which were adulterated. The article was labeled in part: " * '.* *? From P. Leiker & Sons, Park, Kans.' * * *." Examination, by the Bureau of Chemistry of this department, of 900 eggs? from the consignment showed the presence of 167, or 18.5 per cent, inedible? eggs, consisting of black rots, mixed or white rots, moldy eggs, spot rots, and? blood rings. Adulteration of the article was alleged in the information for the reason that? it consisted in part of a filthy, decomposed, and putrid animal substance.
