®882. Misbranding of Haskin's Nervine. U. S. * * * v. 2 Dozen Bottles, et al., of Hasliln's Nex-vine. Default decrees of condemnation, for- feiture, and destruction. (P. & D. Nos. 14479, 14500. Inv. Nos. 29315, 29317. S. Nos. B-3137, E-3154.) On February 25 and 29, 1921, respectively, the United States attorney for the Middle District of Pennsylvania, acting upon a report by the Secretary •of Agriculture, filed in the District Court of the United States for said dis- trict libels for the seizure and condemnation of 4 dozen bottles of Haskin's Nervine, remaining in the original unbroken packages at Wilkes-Barre and Harrisburg, Pa., respectively, alleging that the article had been shipped in part by the Haskin Medicine Co., Binghamton, N. Y., and in part by the Williams Mfg. Co., Cleveland, ' Ohio, on or about October 26, 1920, and Jan- uary 20, 1921, respectively, and transported from the States of New York .and Ohio, respectively, into the State of Pennsylvania, and charging miss branding in violation of the Food and Drugs Act, as amended. Analysis of a sample of the article by the Bureau of Chemistry of this de- partment showed that it was an aqueous solution of Epsom salt, sweetened, col- ored, and flavored. Misbranding of the article was alleged in the libels for the reason that: the labels of the bottles containing the said article bore statements of guar- antee and serial number, together with the statement, " * * * a purely vege- table compound," which were false and misleading in that the said article- was not a purely vegetable compound. As a remedy for diseases- of the Stomach, Liver and Kidneys, Dyspepsia, Indigestion, Loss of Appetite,.. Sick Headache, Dizziness, Female Weakness, Nervous Prostration, Emaciation,.. General Debility, Rheumatism, Heart Trouble, Eruptions of the Skin, Pim- ples, Boils, Tumors, Scrofulous Affections, Cancerous Humors, Salt Rheum,. Catarrh, Ringworm, Carbuncles, Ulcers and Sores, Syphilitic Affections, Ma- larial Poison, Pain in the Bones, or in fact any disease originating from ant. impure state or low condition of the blood and nerves, * * * While eradicat- ing and expelling the germs of disease, it at the same time builds up and: invigorates, giving new life and energy to the whole system," were false and- fraudulent, since the said article contained no ingredients or combination thereof capable of producing the effects claimed. On June 25, 1921, no claimant having appeared for the property, judgments- of condemnation and forfeiture were entered, and it. was ordered by the court, that the product be destroyed by the United States marshal.
