On August 31, 1920, the United States attorney for the Southern District? of Texas, acting upon a report by the Secretary of Agriculture, filed in the? District Court of the United States for said district an information against? Harry W. Sheckley, William O. Thompson, and Cecil O. Phillips, of New York,? N. Y., Herbert E. Wells, of Columbia, S. C, and Elliott B. Church, of Boston,? Mass., trading as the Industrial Cotton Oil Properties, Houston, Tex., alleging? shipment by said defendants, in violation' of the Food and Drags Act, as? amended, on or about December 7, and December 17, 1918, from the State of? Texas into the State of Colorado, of quantities of cottonseed cake, contained? in unlabeled sacks, which was misbranded. Misbranding of the article was alleged in the information for the reason? that it was food in package form, and the quantity of the contents was not plainly? or conspicuously marked on the outside of the package in terms of weight*? measure, or numerical count.
