On Ma-y 6, 1919, the United States attorney for the Northern District of Illinois, acting upon a report by the Secretary of Agriculture, filed in the District Court of tlie United States for said district a libel for the seizure and condemnation of 20 barrels of alleged gelatin, at Chicago, Ill., alleging that tlie article had been shipped on March 3, 1919, by J. O. Whitten & Co. [J.- O. V/hitten Co.], Boston, Mass., and transported from the State of Massachusetts into the State of Illinois, and charging adulteration and misbranding in vio- lation of the Food and Drugs Act. Adulteration of the article was alleged in substance in the libel far the reason that it was composed of a certain substance, to wit, glue, which said substance, containing excessive amounts of arsenic, copper, and mercury, had been substi- tuted for ground gelatin, which the said article purported to be, and had been mixed and packed therewith so as to reduce, lower, and injuriously affect its quality and strength, and for the further reason that it contained added poison- ous and deleterious ingredients, to wit, zinc, copper, arsenic, and mercury, which might render the article injurious to health. Misbranding qf; the article was alleged for the reason that it was an. imita- tion of, and was offered for. sale under the distinctive name of, another article, to wit, ground gelatin. On June 2, 1919, the. J. O. Whitten Co., claimant, having consented to a decree, judgment of condemnation and forfeiture was entered, and it was ordered by the court that the product should be labeled, "NOT TO BE USED FOR FOOD, OR FOR THE MANUFACTURE OF FOOD ARTICLES," and released to said claimant upon the payment of the costs of the proceedings and the execution of a bond in the sum of $1,000, in conformity with section 10 of the act.
