On March 23, 1918, the United States attorney for the Northern District of?
Texas, acting upon a report by the Secretary of Agriculture, filed in the District?
Court of the United States for said district a libel for the seizure and con??
demnation of 4 barrels of an article purporting to be gelatin, at Dallas, Tex.,?
alleging that the article had been shipped on or about December 1, 1917, and?
December 22, 1917, by the Consumers Glue Co., a corporation, St. Louis, Mo.,?
and transported from the State of Missouri into the State of Texas, and?
charging adulteration in violation of the Food and Drugs Act. The article was?
labeled in part, " Tech. Gel."
Adulteration of the article was alleged in the libel for the reason that glue?
had been mixed and packed with the article so as to reduce and lower and?
injuriously affect its quality and strength, and had been substituted for gelatin,?
which the article purported to be; and for the further reason that it contained?
an added poisonous and deleterious ingredient, to wit, zinc, which might render?
the article injurious to health.
On June 4, 1918, the said Consumers Glue Co., claimant, having consented?
to a decree, judgment of condemnation and forfeiture was entered, and it was?
ordered by the court that the product should be released to said claimant upon?
the payment of the costs of the proceedings and the execution of a bond, in?
the sum of $1,000, in conformity with section 10 of the act.
