On July 17, 1917, the United States attorney for the Eastern District of Oklahoma,? acting xipon a report by the Secretary of Agriculture, filed in the District Court of the? United States for said district an information against the Apache Cotton Oil &? Manufacturing Co., Chickasha. Okla., alleging a shipment by said company, on or? about March 2, 1916, from the State of Oklahoma into the State of Iowa, of a quantity? of an article labeled in part, "Owl Brand High Grade Cotton Seed Meal," which was? misbranded. Analysis of a sample of the article by the Bureau of Chemistry of this department? showed the following results: Crude fiber (per cent)? ?12.6 Nitrogen (per cent)? ?" 6. 22 Ammonia (per cent)? 7.56 Protein (N X 6.25) (percent)? ?38.9 These results show that this sample contains more crude fiber and? less nitrogen, ammonia, and'protein than declared on the label. Misbranding of the article was alleged in the information for the reason that the? statement, to wit, "High Grade Cotton Seed Meal * * * Protein 41? * * *? minimum * * * frequently runs higher, * * * Fibre, maximum 10?,"? borne on the tag attached to the sacks, regarding the article and the ingredients and? substances contained therein, was false and misleading in that it represented that the? article contained not less than 41 per cent of protein and not more than 10 per cent? of fiber; and for the further reason that it was labeled as aforesaid so as to deceive and? mislead purchasers into the belief that it contained not less than 41 per cent of protein? and not more than 10 per cent of fiber, whereas, in truth and in fact, it contained less? than 41 per cent of protein and more than 10 per cent of fiber, to wit, approximately? 38.9 per cent of protein and approximately 12.6 per cent of fiber.
