I. S. No. 10720-m.) On May 1,1917, the United States attorney for the Eastern District of TexaB, acting? upon a report by the Secretary of Agriculture, filed in the District Court of the United? States for said district an information against The White Produce Co., a corporation,? Denison, Tex., alleging shipment by said company, in violation of the Food and? Drugs Act, on or about August 10, 1916, from the State of Texas into the State of? Kansas, of a quantity of eggs which were adulterated. Examination of the article, which consisted of 1 case of 30 dozen eggs, by the Bureau? of Chemistry of this department showed 266, or 73.8 per cent, of inedible eggs. Adulteration of the article was alleged in the information for the reason that it? consisted in whole or in part of a filthy, putrid, and decomposed animal substance. On January 8, 1918. the case having come on for trial before the court and a jury,? after the submission of evidence, the jury returned a verdict of guilty by direction of? the court, and thereupon the court imposed a fine of $25 and costs.
