On July 24, 1917, the United States attorney for the Southern District of New York, acting upon a report by'the Secretary of Agriculture, filed in the District Court of the United States for said district an information against The Pausch Bros. Oyster Co., a corporation, Port Chester, N. Y., alleging ship- ment by said company, in violation of the Food and Drugs Act, on January 11, 1916 (two shipments), from the State of New York into the State of Minnesota, of quantities of oysters which were adulterated. Analysis of samples of the article by the Bureau of Chemistry of this depart- ment showed the following results :. No. 1. No. 2. Adulteration of the article in each shipment was alleged in the information for the reason that a certain substance, to wit, water, had been mixed and packed therewith so as to reduce, lower, and injuriously affect its quality and strength, and had been substituted in part for oysters, which the article pur- ported to be.
