On May 9, 1916, the United States attorney for the Western District of Penn?? sylvania, acting upon a report by the Secretary of Agriculture, filed in the Dis-? iriet Court of the United States for said district a libel for the seizure and con?? demnation of 125 cases of pork and beans, consigned by the Wisconsin Pea Oan-? ners Co., Manitowoc, Wis., and remaining unsold in the original unbroken pack?? ages at Pittsburgh, Pa., alleging that the article had been shipped and trans?? ported from the State of Wisconsin into the State of Pennsylvania, and received? at Pittsburgh on or about February 11, 1916, and charging adulteration in vio?? lation of the Food and Drugs Act. The article was labeled in part; " Eureka? Brand High Grade Pure Food Products Pork and Beans with Tomato Sauce? Quality Guaranteed." Adulteration of the article was alleged in substance in the libel for the? reason that it consisted, in whole or in part, of a decomposed vegetable sub?? stance, unfit for food. On December 13, 1916. the said Wisconsin Pea Canners Go., a corporation,? claimant, having admitted the allegations contained in the libel and consented? to a decree, judgment of condemnation and forfeiture was entered, and it was? ordered by the court that the article be redelivered to said claimant upon the? payment of the costs of the proceedings and the execution of a bond in the? sum of $500, in conformity with section 10 of the act.
