On March 21, 1912, the United States attorney for the Western District of? Pennsylvania, acting upon a report by the Secretary of Agriculture, filed in? the District Court of the United. States for said district an information? against Hardie Bros. & Co., a corporation, Pittsburgh, Pa., alleging shipment? by said company, in violation of the Food and Drugs Act, on February 14,? 1911, from the State of Pennsylvania into the State of Illinois, of a quantity? of candy known and designated as " Cream Bird Eggs " which was adulterated. Analysis of a sample of the product by the Bureau of Chemistry of this? department showed that said product contained talc. Adulteration of the article was alleged in the information for the reason? that it contained talc, a mineral substance. On November 6, 1915, the defendant company withdrew its plea of not? guilty theretofore entered and entered a plea of guilty to the information,? and the court imposed a fine of $25 and costs.
