NOTICE OF JUDGMENT NO. 2480. (Given pursuant to section 4 of the Food and Drugs Act.) V. S. v. Alart etc Maure Co. Plea of guilty. Fine, $50. ADULTEEATION OF OLIVES. On February 4, 1913, the United States Attorney for the Southern District of New York, acting upon a report by the Secretary of Agriculture, filed in the District Court of the United States for said district an information against Alart & Maguire Co., a corporation, New York, N. Y., alleging shipment by said company, in violation of the Food and Drugs Act, on October 31, 1911, from the State of New York into the State of Kentucky, of a quantity of olives which were adulterated. The product was labeled: " W-97. Hirsch Bros. Co., Louisville, Ky." Examination of samples of the product by the Bureau of Chem- istry of this Department showed that from 32 to 43 per cent of them contained worms, and that from 25 to 33 per cent were worm-eaten; they appeared to be culls. Adulteration of the product was alleged in the information for the reason that it consisted in part of a filthy and decomposed animal and vegetable substance, to wit, of worms and wormy excrement. It will be noted that the examination of the product did not show "the presence of wormy excrement.
