On or about October 9, 1909, A. Fiore, doing business as A. Fiore? & Co., New York, N. Y., shipped from the State of New York into? the State of New Jersey a quantity of a food product labeled: " Olio? d'Oliva Puro Marca Colombo, Pure Olive Oil." Samples from this? shipment were procured and analyzed by the Bureau of Chemistry,? United States Department of Agriculture, and the product was found? to contain more than 75 per cent cottonseed oil. As it appeared from? the findings of the analyst and report made thereon that the product? was misbranded within the meaning of the Food and Drugs Act of? June 30, 1906, the said A. Fiore and the party from whom the sam?? ples were procured were afforded opportunities for hearings. -As it? appeared after hearings held that the said shipment was made in? violation of the act, the Secretary of Agriculture reported the facts? to the Attorney-General with a statement of the evidence upon which? to base a prosecution. In due course a criminal information was filed in the Circuit Court? of the United States for the Southern District of New York against? said A. Fiore, charging the above shipment and alleging that the? product so shipped was misbranded in that it was labeled as above? set forth, so as to deceive and mislead the purchaser thereof, in that? the said label indicated that the contents of such container was a? foreign product, to wit, pure olive oil from the Kingdom of Italy,? whereas in truth and in fact it was not a foreign product but a do?? mestic product, consisting almost entirely of cottonseed oil. Upon arraignment the defendant entered a plea of guilty to the? above information and the court suspended sentence. This notice is given pursuant to section 4 of the Food and Drugs?
